STANDARD TERMS

1.1 Information on how to enter and on the Competition Site forms part of the terms of entry.

1.2 The Competition is a game of skill with no elements of chance.

WHO CAN ENTER

2.1 Subject to clause 2.2 and 9.1, entry is open to Australian 18+ years of age residents only.

2.2. Employees, franchisees, and the immediate families of We Are Explorers and Partners or any related agencies, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, or step-sister. Freelancers or those who have completed contract work through We Are Explorers are permitted to enter.

HOW TO ENTER

3.1 The Competition commences on 17/07/24 at 10:00 AM AEST and closes 16/08/24 at 11:59 PM AEST (“the Competition Period”).

3.2 In order to enter, one must complete the entry form on the Competition Site by providing: 

  • Full name (“The Entrant”), email address, and submission.
  • A brief title for the Entry
  • A photo, video, or written submission.

3.3 In order to enter, The Entrant must agree to receive email marketing communications from the Promoter and Competition Partners. The Entrant may unsubscribe to email marketing from the Promoter and Competition Partners at any time after receipt of the first promotional email from the Promoter.

3.4 The Entrant may enter multiple times. The entry fee is the cost of one entry into the competition.

3.5 By entering the Competition, The Entrant consents to and grants a royalty-free perpetual licence to the Promoter and the Competition Partners to use the winning Entrant’s name, in accordance with clause 12.4 below. Intellectual property rights of the Entry are specified in clause 7.1.

ENTRY CONDITIONS

4.1 The Promoter reserves the right to disqualify an entry that doesn’t meet the conditions stated in these Terms. A disqualified entry will not be refunded.

4.2  Each Participant warrants to the Promoter that:

4.2.1 Their submissions are their own words that do not infringe on any copyright or privacy laws, or rights of any third party; including but not limited to, copyright, trademarks, trade secrets, privacy, publicity, personal, confidentiality or proprietary rights. A third party may not submit films on behalf of someone else; 

4.2.2 No Entry submitted by them will contain viruses or cause injury or harm to any person or entity; and in relation to their Entry, they have and will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, or privacy.

4.2.3 The entry is non-fiction and tells a true story.

4.3  The Entrant agrees to indemnify the Promoter against any third party claims in connection with a failure by them to comply with these Terms.

4.4  The Entrant agrees that they are fully responsible for each Entry they submit, and is fully responsible for any equipment, materials, licences, or other costs required for or associated with each such Entry. To the fullest extent permitted by law, the Promoter excludes any liability, or any costs borne by The Entrant in submitting their Entry. The Entrant must have appropriate permissions to use any soundtrack or music prior to entering.

4.5 An Entry in the Phone Photo category must have been photographed using a mobile phone camera. 

4.6 The Promoter reserves the right to request raw files and metadata of an Entry to ensure it meets these Terms. 

4.7 Upon request the Entrant must be able to provide full-resolution image or video to be used to display shortlist and winners.

DIGITAL MANIPULATION

5.1 For the Phone Photo, Adventure Photo and Nature Photo Categories any post-processing must be the work of The Entrant.

5.2 Photos must be single capture, not composites, with the following exceptions: Stitched panoramas, focus stacks and HDR images may be entered if captured at the same location (within a reasonable time period) to form a single photo.

5.3 Photos and video may be processed in post-production to adjust photographic variables only, such as cropping, noise, sharpness, colour, tone and contrast, including dodging and burning and black-and-white conversions. Pixels may not be added or removed, with the following exceptions: Digital lens and perspective corrections and cloning to remove dust spots and minor distractions are allowed.

5.4 Competition organisers reserve the right to disqualify a photo or video if they feel it lacks authenticity due to over-manipulation. 

ARTIFICIAL INTELLIGENCE 

6.1 Entries across all Categories must have been entirely captured with a camera or written in their own words.

6.2 Entries created in part, or full, by artificial intelligence using image-creation or text-generation programs (for example, chat GPT, MidJourney, DALL-E, etc) will be disqualified.

6.3 Photos and video edited using Generative AI in programs such as Photoshop, Topaz Photo AI, etc, where pixels are added that did not exist in the original photo, may not be entered. 

6.4 The Promoter reserves the right to request the original image or video files to verify the integrity of an entry.

INTELLECTUAL PROPERTY RIGHTS

7.1 The Entrant retains copyright of their photo, video or written work. The Entrant provides The Promoter and Competition Partners a limited-use authorisation to display, print, and distribute their entry for the sole purpose of promoting the Competition and its future iterations. The Promoter can alter the entry to suit promotional purposes (ie. cropping or overlaying text).

7.2 The Entrant must be the creator and copyright owner of the photo, video, and written work they enter into the competition. Entries submitted into the Video Category must have permissions from those who have contributed to the Entry (ie. Additional Camera, Video Editor, etc).

EXCLUDED TOPICS AND SUBJECTS


Respect of Flora and Fauna

8.1 Entries must promote safe interactions with flora, fauna, and Country, to help ensure their protection. Entries cannot feature:

  • Holding or touching native animals (unless you’re a trained specialist or ecologist, and this is part of mandatory monitoring)  
  • Being an unsafe distance from native animals 
  • portrayal of native plants and animals, and landforms in a disrespectful manner.



Illegal or dangerous activities

8.2 Entries cannot feature any activity that may be illegal in Australia or in the country featured in the submission. Dangerous, high risk or reckless activities that one would reasonably understand to not be covered by a travel insurance company are also not permitted.

8.3 Entries should not feature subject matter that involves:

  • Hunting
  • Racing (other than on foot)
  • Polo playing
  • Hang gliding
  • Rodeo
  • Base jumping
  • Motocross
  • Freestyle BMX
  • Running with the bulls
  • Playing sports in a professional capacity
  • Failing to take reasonable care while travelling
  • Flying in anything other than a fully licensed passenger carrying aircraft
  • Travel in war zones or civil unrest
  • Travel while pregnant after the start of the 24th week of pregnancy or with known complications of the pregnancy
  • Childbirth in another country

Drug use or intoxication

8.4 Entries cannot feature drug use or drug abuse, intoxication of alcohol or intoxication of any kind, including hallucinogenic plant medicine.

Offensive topics

8.5 Entries should not feature subjects that would offend good taste or community expectations. Keep it classy.

Locations 

8.6 Entries must not have been captured in or include reference to the following countries:

  • Iran
  • Syria
  • North Korea
  • Israel and Occupied Palestinian Territories
  • Ukraine
  • Belarus
  • Russia
  • Libya
  • Myanmar
  • Zimbabwe

8.7 The Entrant must exercise caution when including countries which are considered medium to high risk based on safety issues and ‘Do not travel’ warning issued by governmental officials in their Entry.

JUDGING OF ENTRIES, PRIZES AND UNCLAIMED PRIZES

9.1 The winners will be chosen by a public vote and judging panel as outlined in clause 10.2.

9.2 The winners will be announced on 12/09/2024 and notified by email.

9.3 Prizes cannot be exchanged or refunded in any way by the winner.

9.4 Any prizes that remain unclaimed for 1 month after the end of the Competition Period will be awarded to another Entrant as determined by the Promoter. If required, this will occur on 12/10/2024.

SELECTION OF WINNERS

10.1 The Entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 will be reviewed by the Promoter and approved for entry into the Competition and appear on the Competition Site.

10.2 Entries will be shortlisted by public vote on the Competition Site. At the completion of the Competition Period the five Entries with the highest amount of votes in each category will form that category’s shortlist.

10.3 Shortlisted entries (as selected in 10.2) will be voted upon by a judging panel. Each category will have two judges as stated on the Competition Site who will use their discretion to select winners fitting to the category description. 

10.4 The winner of the Competition, as determined by the judging panel, agrees to provide proof of age to We Are Explorers and any Competition Partners if deemed necessary by the Promoter.

10.5 The Judging Panel and Promoter’s decision is final.

10.6 The entry with the most public votes during the competition period will win Freely Travel Insurance for their next trip valued at $1200 and a G Adventures Classic Peru trip valued at $3849 AUD with travel-by date of 31 July 2025.

10.7 The shortlisted entry that receives the most votes from attendees of the 10 year anniversary party will be awarded The Dometic Adventure Pack valued at $3849 (pack outlined in Prizes section).

NO LIABILITY

11.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition or other as subject to any State Legislation.

11.2 The Promoter, its associated agencies and companies, and the Competitions Partners, will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail or email.

11.3 The Promoter, its associated agencies and companies, and the Competition Partners will not be liable to the Entrants or winners for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

11.3.1 during the Competition;

11.3.2 whilst undertaking any travel won in connection with their entry into the Competition;

11.3.3 in the participation in any prize;

11.3.4 as a consequence of late, lost or misdirected mail or email;

11.3.5 due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; or

11.3.6 due to circumstances outside the Promoter’s, or any Competition Partners’ reasonable control.

11.4 The Promoter, its affiliates, and the Competition Partners, assume no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorised access to, or alteration of, entries, and reserve the right to take any action that may be available.

11.5 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserve the right, at their discretion, to disqualify any individual who tampers with the entry process or any other dishonest act, may take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to State Legislation.

RESOLVING DISPUTES

12.1 Any Entrant may email the Promoter (jack@weareexplorers.co or tim@weareexplorers.co) and state their dispute.

12.2 The Promoter will be required to respond within 30 days and set a time for questions and answers if desired by the Entrant.

12.3 From the date of response, a final written decision from the Promoter will be supplied containing concise, reasoned decisions.

12.4 The details contained in your entry are protected by security safeguards as detailed in the Promoter’s Privacy Policy. The personal information collected as part of the entry is collected to run the Competition, enable identification of the winner, and for future marketing and promotional purposes by the Promoter and the Competition Partners. Your personal information will only be disclosed to the Promoter and its related corporate bodies and other listed Competition Partners, for these purposes, and the relevant Privacy Policies can be accessed via each of the Competition Partners’ website.
